Professional duties of party wall surveyors

Abstract

This paper explains the correct and professional way in which surveyors should undertake the role of an appointed surveyor under the Party Wall etc Act 1996. It explains the statutory framework within which the surveyors operate and the proper and practical way they should liaise with other appointed surveyors and advise their Appointing Owner on matters both within and without the scope of the Party Wall etc Act 1996.

Author's Biography

Alistair Redler is a partner in Delva Patman Redler LLP. He joined the practice in 1993, becoming a partner in 1994. Alistair is a recognised specialist in fields of neighbour law, including party walls, rights of light, daylight/sunlight and boundary disputes. He is a past chairman of the Boundaries and Party Walls Working Group of the RICS, which advises the RICS on relevant neighbour law matter. Alistair was on the working groups that produced the current RICS Party Walls Guidance Note and current RICS Daylight/Sunlight Guidance Note. He was the RICS spokesman for the discussions that led to the High Hedges provisions in the Anti-social Behaviour Act 2003 and is the author of the College of Estate Management Study Pack ‘Party Walls — The Law and The Surveyor’s Role’. Alistair’s book ‘The Practical Neighbour Law Handbook’ is published by RICS Books.
