Abstract
This paper discusses the European legal framework, the guidelines, the Italian context and the essential issues, including whether the data protection officer (DPO) is a strategic role or an operational role. The paper also asks, Should the DPO be an internal function or an external professional, and what does expert knowledge of data protection law and practices mean? What is the sufficient time for a DPO to fulfil their tasks, and what does it mean to be easily accessible from each establishment?

Author's Biography
Donato La Muscatella is an attorney, Certified Information Privacy Professional/Europe, qualified implementer and auditor on ISO/IEC 27001:2013 standard. His work focuses on data protection and ICT law issues, even as Data Protection Officer, both for small and medium-sized enterprises and large companies. He has published more than 15 papers in peer-reviewed journals and has been part of the team that drafted the Italian edition of the Council of Europe’s Electronic Evidence Guide. As a lecturer, he has presented his research findings at several conferences and participated in courses and seminars on data protection, digital evidence and ICT topics, held by Italian universities and police force training institutions. He graduated cum laude in law from the University of Ferrara and has specialised in digital investigations at the University of Milan.
