Abstract
This paper looks at the basic elements required to make out a claim in professional negligence against a surveyor, dealing with issues relating to duty of care, breach of duty, causation and loss. Defences, exclusions and limitations of liability are considered, as are the instances in which they are most likely to be successfully deployed. Case law is used to provide examples as well as guidance on ways to avoid negligence.
