Applying the repairing covenant : The what, the why and the how

Abstract

This paper concentrates on the duties incumbent upon surveyors when preparing a dilapidations survey. It focuses on the differences in approach depending on the purpose of the survey, the duty of care incumbent, and to whom such duties are owed, and provides an update of legal developments in the area.

Author's Biography

Gillian Craig is a commercial dispute resolution partner in the Scottish law firm of MacRoberts LLP. She is a property litigation specialist with experience of eg lease disputes, enforcement of missives, reduction, rectification and title conditions. In addition to real estate work, she also handles diverse commercial claims from professional negligence, banking and pensions to corporate disputes and insolvency. Gillian regularly appears in the sheriff courts and instructs Court of Session actions, in addition to Lands Tribunal work. She is also experienced in arbitrations and mediations. She is a committee member of the Property Litigation Association, joint senior tutor of Civil Court Practice in the Diploma of Legal Practice at Glasgow University and a member of the Law Society of Scotland Commercial Mediation Accreditation Panel. Her work contributed to MacRoberts being shortlisted for Commercial Team of the Year at the British Legal Awards 2016.
