Abstract
This paper examines the right to data portability as one of the new rights of the General Data Protection Regulation (GDPR), its legal requisites and what data should and should not be submitted by a controller that receives a data portability request. It also analyses the ethos behind the right to data portability, how it comes at odds with the current status quo of data sharing and why it matters to fulfil the objectives of the European Single Digital Market.

Author's Biography
Jose Belo is Of Counsel on Data Protection and Privacy at Teofilo dos Santos Law Firm. Before, he was Counsel for technology, IP, privacy and data protection at DATTA – Privacy Solutions, a data privacy consulting firm in Portugal. Jose is also co-chair of the International Association of Privacy Professionals’ (IAPP) Lisboa (Portugal) KnowledgeNet Chapter, a lecturer at the Data Protection Officer (DPO) Academy at Rumos (Porto, Portugal), founding member and current board member of the Portuguese DPO and Other Privacy Professionals Association (ANDPO). He is also a keynote speaker at multiple events in Portugal and across Europe on data protection, privacy and its implications for technology. Jose holds an LL.B in law from the University of Coimbra and a Law and Technology Certificate from the University of California at Berkeley’s Boalt Hall School of Law.
Patricia Macedo Alves is Chief Executive Officer (CEO) of DATTA — Privacy Solutions, a data privacy consulting firm in Portugal. Patricia is the Data Protection Officer (DPO) of multiple companies and has worked in privacy and data protection for many years, specialising in marketing and privacy matters. Through DATTA, Patricia helps companies manage the General Data Protection Regulation (GDPR) compliance and advice. Patricia is a lawyer, holds an LL.B in law and a post-graduate (LL.M) in IT law and business law from the University of Minho, and is a lecturer at the DPO Academy at Rumos, one of Portugal’s leading executive education companies. Patricia is also a member of the IAPP and a founding member and current member of the Fiscal Council of the Portuguese DPOs and Other Privacy Professionals Association (ANDPO).
