The new National Planning Policy Framework and National Planning Policy Guidance: An illustration of case law influencing government policy

Abstract

This paper reflects on the new National Planning Policy Framework (NPPF)1 which was published on 24 July 2018. The paper highlights issues which those interested in developing land need to be aware of and how it has, in many respects, been influenced by recent case law. This represents the largest overhaul of national planning policy since the introduction of the current NPPF in 2012.

Author's Biography

Jamie Childs is a solicitor at leading regional law firm, Howes Percival LLP. Jamie advises developers, landowners and promoters on all aspects of planning law across a wide variety of residential and commercial development projects. In addition to providing strategic advice to help clients secure robust planning permissions and regularly negotiating section 106 and highway agreements, Jamie also has experience in dealing with planning appeals, statutory challenges and judicial review claims. Jamie also advises on niche areas of planning law including town and village greens, assets of community value and community infrastructure levy.

Paul Wootton is a partner and the head of Howes Percival LLP’s planning team. Paul advises developers, landowners, public sector clients and promoters on all aspects of planning law, compulsory purchase and highways law and has acted on some of the largest regeneration and energy projects in England and Wales. His most recent experience relates primarily to residential development schemes and he is currently advising on projects which will deliver in excess of 10,000 homes and of which have been consented using housing land supply arguments.
