Schedules of condition referred to in leases of commercial property in the UK : Are they effective?
Abstract
Schedules of condition are probably not as effective as tenants expect them to be. The parties’ advisers should be passing on this information. Alternatives to reference to a schedule of condition should be considered by the parties to a lease. This paper argues that if a schedule of condition is the preferred option, it should be much more detailed than just a few photographs and some text. Author's Biography
FCIArb FRICS is a Chartered Building Surveyor and, since 2024, Director at Jones Lang LaSalle and head of their dilapidations services. Jon practises as an arbitrator, expert witness, independent expert and, in Scotland, as court reporter. He is author of the ‘TFT Purple Book: A Guide to Dilapidations in the UK’, published in 2018, lead author of the current version of the Royal Institution of Chartered Surveyors (RICS) ‘Dilapidations Guidance Note (England and Wales)’ and lead author of the RICS ‘Dilapidations Dispute Resolution Scheme’. Jon was chair of the RICS Dilapidations Forum from 2010 to 2015 and represented RICS in discussions with the Ministry of Justice Rule Committee and the Property Litigation Association regarding the final drafting of the Dilapidations Protocol. He is a member of the RICS UK Building Surveying Professional Group Board (2009–14) and the RICS President’s Panel of Dilapidations Independent Experts, an RICS Accredited Mediator of Civil Disputes, RICS accredited expert witness, Fellow of the RICS, Fellow of the Chartered Institute of Arbitrators, and Freeman of the Worshipful Company of Arbitrators and of the City of London. Jon holds an HND in building studies, BSc (Hons) in building surveying, PGDip in construction and real estate, RICS Diploma in arbitration, MBA in construction and real estate, and is currently studying for an LLM in construction law and dispute resolution.
